In compliance with the Texas Property Code, the following information is provided in regards to the operation and governance of this Association.

The Corporation reserves the right to impose fines and liens for any violations of the Bylaws and Covenants of Hurricane Creek Estates Association, Inc as follows:
1. A member may submit a written or electronic complaint to the Board of Directors about a violation of the Covenants and/or Bylaws.
a. The Board of Directors may also directly initiate a complaint.
2. The Board of Directors shall determine the appropriate response within 10 calendar days as follows:
a. No action will be taken, if there is no authority to address the complaint through the Association or government entities.
b. The complaint will be forwarded to the appropriate enforcement entity, such as Collin County or the City of Anna.
c. The complaint will be addressed with enforcement action through the Association.
i. The Board of Directors may, at their discretion, attempt to informally address complaints within their authority before initiating formal action.
3. Enforcement action by the Association will be conducted as follows:
a. A written notice of the violation and requested remediation will be provided to the violator via US Mail.
i. The violator will be given 21 calendar days from the postmarked date to respond and/or remediate the violation.
ii. An appeal pursuant to Texas Property Code Section 209.007 may be requested before the Board of Directors to resolve the violation.
b. If the violation is not remediated within 10 days, or if appeal is denied, or no response is received from the violator, a fine shall be imposed by the Association as follows:
i. $50 for the first offense, payable 30 days after receipt. Filing, legal, and any other fees incurred by the Association shall be added to any amount owed.
1. If the violation is Yard Maintenance, the fine amount will be equal to the cost of bringing the property into compliance and any associated fees.
ii. Nonpayment will result in a lien applied the property for the full amount.
c. If the violation is not remediated 15 days after the first fine is imposed, an additional fine of $100 shall be charged.
i. Filing, legal, and any other fees incurred by the Association shall be added to any amount owed.
ii. Nonpayment will result in a lien applied the property for the full amount.
d. Additional fines of $100 shall be imposed every 15 days until the violation is remediated, up to a maximum of $1000.
i. Filing, legal, and any other fees incurred by the Association shall be added to any amount owed.
ii. Nonpayment will result in a lien applied the property for the full amount.
4. The preceding section shall serve as the Schedule of Fines and posted on the official website pursuant to the Texas Property Code Sec 209.
This section supersedes any penalties, liens, fines, and other enforcement actions enumerated in the Covenants and Bylaws of Hurricane Creek Estates Association, Inc.
Article 10 of the Bylaws specifies the dues required of members:
In accordance with Section 209 of the Texas Property Code, any property sold or transferred after April 1, 2025, will necessitate the new owner(s) to remit a one-time initiation fee to the Corporation at the time of sale closure. The calculation of this fee will be the greater of either 0.08% of the property’s sale price or a flat rate of $400. This initiation fee represents the sole financial commitment from the owner(s) to the Corporation, as there are no additional recurring or regular dues.

A formal complaint will need to be submitted in writing or by email. The Board will review the complaint and respond within 10 business days. If an enforcement action is warranted by the complaint, the process will be initiated by the Board in accordance with the Covenants and Bylaws.
Article III, Section A of the Covenants requires that any new construction or addition to existing structures must be approved by the Building Committee BEFORE construction begins. The board does not intend to interfere in any owner's property rights, but the board is obligated to ensure that the structure conforms to our bylaws and covenants. We also want to make sure small oversights are corrected before they become costly issues for homeowners to correct. Failure to comply may result in a lien being placed on your property.
